I’m self-employed, how does sick leave work?

I'm 20 weeks pregnant & my employer is putting me under a lot of stress at work which is upsetting me. My doctor has said that they can sign me off work with pregnancy related stress. I also have my own business. Would I still be able to work for my own business even though I am off work? I need to continue in order for my business to succeed, if I wasn't able to, this would add to my stress!

From your question, you are going through a period of stress at work which is upsetting you and you are pregnant. You would like to know if it’s ok for you to continue working at home on your own business if you were signed off work by your doctor for pregnancy related stress. You say that if you are not able to continue working on your business, then this would add to your existing stress.

If your doctor (GP) has given you a legitimate reason to take sick leave from your employment based on you suffering from pregnancy related stress then of course it is fine for you to take this as stress during pregnancy should be limited as much as possible to ensure the good health of you and your baby.

You don’t mention what type of work you do or what kind of business you have. Unfortunately we would not be able to confirm whether or not you could continue with your own business during the time you have taken off sick from your employment.

We would recommend speaking to an independent expert regarding this so it might be a good idea to contact ACAS. This can be a good option also if you do not want to directly involve your employers at this stage. ACAS are the Advisory, Conciliation and Arbitration Service and can advise on many aspects of employment and give you further free, confidential and impartial advice on what legal options you may have and give you detailed information about your rights. You can call their helpline on 08457 47 47 47.

You could also contact your local Citizens Advice Bureau (CAB) as they have advisors who are trained in employment law and can give you information on your rights in your situation.

There are ways of coping with stress including relaxation techniques and thinking positive. You might find MIND’s Guide to Managing Stress useful for ways of dealing with stress on a day-to-day basis. Stress can also have an effect on your health and concentration levels. Therefore, it is important that you eat well and keep your energy levels up when you are feeling stressed. Avoid food that makes you feel lethargic which affects your concentration and motivation, and try to maintain a balanced diet and stay hydrated.

If you feel your stress levels are becoming too high it may be worth considering visiting your GP again for further support and advice.

Hopefully you will find this information helpful but please do not hesitate to contact us if you have any further queries.
